Apesar das propagandas dos sites de apostas esportivas serem comuns na TV, o público deve tomar alguns cuidados. O mercado brasileiro movimenta cerca de R$ 4 bilhões em mais de 500 sites de apostas, de acordo com estudo da FGV encomendado pela Caixa.
A aposta é simples: o interessado se registra, depositar qualquer valor por boleto ou transferência, e sua conta é gerada com o valor do depósito inicial. A partir daí, é só tentar adivinhar o resultado dos jogos esportivos, sendo que, quanto maior o risco, maior o retorno.
Entretanto, é preciso ficar atento. Se o site provedor das apostas estiver hospedado no Brasil, a aposta pode ser considerada contravenção penal. Isso porque nossa lei considera lícitos somente os jogos administrados pela Caixa e as apostas em corridas de cavalo no jóquei. O resto é infração.
Boa parte das bancas, porém, hospedam seus sites fora do Brasil, em países em que o jogo é legal. Sportingbet, BET360 ou 188BET, os maiores em atuação, fogem da lei brasileira.
Outro cuidado que o jogador deve tomar é que deve declarar à Receita Federal o valor recebido em apostas para pagar o tributo. Caso não declare, pode ser considerado um crime de evasão de divisas.
Além das questões de legalidade, o jogador ainda correr um risco que vai além da própria natureza de errar o palpite e perder dinheiro: o calote. Quando resultados improváveis acontecem simultaneamente, banca de algumas casas de apostas não conseguem honrar seus pagamentos. Isso aconteceu na 13ª rodada do Campeonato Brasileiro deste ano, quando muitos apostadores ficaram sem receber.
E não há muito o que fazer, já que, como o jogo não é liberado, não tem fiscalização, o que também torna mais difícil controlar fraudes esportivas, como a manipulação de resultados.
A Comissão de Constituição, Justiça e Cidadania do Senado rejeitou a aprovação do projeto de lei (PLS 186/2014) que regulamenta bingos, jogo do bicho, videojogo e outras modalidades de apostas de forma legal. Cabe ao plenário da Casa votar o projeto. (Com informações do Uol.)
